Return, Replacement, Warranty & Limitation of Liability Policy – Zeyond Clinical

Welcome to Zeyond Clinical. By purchasing through our website, physical store, authorized distributors, or any official sales channel, the customer acknowledges that they have read, understood, and agreed to the following Return, Replacement, Warranty & Limitation of Liability Policy.

This policy has been drafted in accordance with the applicable laws and regulations of the United States of America and the Commonwealth of Puerto Rico, including provisions related to e-commerce, consumer transactions, commercial sales, limitation of liability, and applicable warranties.


1. ALL SALES ARE FINAL

All sales made by Zeyond Clinical are considered final.

NO REFUNDS, PARTIAL REFUNDS, OR MONETARY CREDITS WILL BE ISSUED UNDER ANY CIRCUMSTANCES, including but not limited to:

  • Change of mind
  • Subjective dissatisfaction
  • Buyer error
  • Compatibility issues
  • Improper use
  • Expectations differing from the product purchased
  • Lack of technical knowledge
  • Delays caused by third parties
  • Installation or setup costs
  • Damages occurring during use

By completing a purchase, the customer expressly agrees to these irrevocable conditions.


2. LIMITED REPLACEMENTS AND EXCHANGES

Zeyond Clinical will only consider replacements or exchanges for equipment when:

  1. The equipment presents a genuine operational defect.
  2. The defect has been verified exclusively by one of our authorized technicians.
  3. The issue is determined to be caused by manufacturing defects or normal equipment malfunction.
  4. The equipment shows no evidence of negligence, abuse, alteration, misuse, or mishandling.

The final determination regarding whether equipment qualifies for replacement shall be made solely by Zeyond Clinical, and such decision shall be final and non-appealable.


3. EQUIPMENT NOT ELIGIBLE FOR REPLACEMENT OR WARRANTY

The following conditions void eligibility for replacement, warranty service, exchange, or free technical support:

  • Drops, impacts, or accidents
  • Exposure to liquids, moisture, or fire
  • Electrical surges or improper voltage use
  • Negligent or improper use
  • Incorrect installation
  • Unauthorized repairs
  • Physical or electronic modifications
  • Tampering by third parties
  • Normal wear and tear
  • Improper commercial use
  • Use outside recommended technical guidelines
  • Lack of maintenance
  • Cosmetic damages
  • Improper transportation by the customer
  • Use contrary to manuals or provided instructions

Any indication of tampering, unauthorized modification, or external damage may immediately void any eligibility for replacement.


4. MANDATORY TECHNICAL INSPECTION

All reported equipment must undergo technical inspection.

The customer acknowledges and agrees that:

  • Evaluations will be conducted exclusively by authorized Zeyond Clinical personnel.
  • The technical diagnosis issued by our specialists shall be conclusive and binding.
  • Zeyond Clinical may reject any claim that does not meet the established requirements.
  • Approval of a replacement does not constitute an admission of legal liability by Zeyond Clinical.

Zeyond Clinical reserves the right to request:

  • Photos
  • Videos
  • Serial numbers
  • Proof of purchase
  • Detailed descriptions of the issue
  • Additional technical evidence

5. TIMEFRAME TO REPORT DEFECTS

Any malfunction claim must be reported within a reasonable period from the original purchase date.

Equipment reported within the first sixty (60) calendar days from the original purchase date may qualify for replacement, subject to inspection and technical approval.

After the initial 60-day period:

  • Replacement may involve additional costs.
  • Administrative fees may apply.
  • The customer shall be responsible for shipping, handling, and processing fees.
  • Replacement availability is not guaranteed.

6. SHIPPING AND HANDLING COSTS

Unless otherwise determined in writing by Zeyond Clinical:

  • The customer is responsible for all shipping costs related to inspections, evaluations, or replacements.
  • Original shipping costs are non-refundable.
  • Zeyond Clinical is not responsible for loss or damage caused during transportation handled by third-party carriers.

Customers are strongly encouraged to use insured shipping services with tracking numbers.


7. LIMITATION OF LIABILITY

To the maximum extent permitted under the laws of the United States and Puerto Rico, Zeyond Clinical, including its owners, directors, employees, affiliates, representatives, suppliers, and distributors, shall NOT be liable for:

  • Indirect damages
  • Incidental damages
  • Special damages
  • Economic losses
  • Loss of income
  • Loss of business opportunities
  • Consequential damages
  • Loss of data or information
  • Injuries resulting from improper use
  • Unauthorized use of equipment
  • Damages caused by third parties
  • Operational interruptions
  • Technical incompatibilities

Under no circumstances shall the total liability of Zeyond Clinical exceed the original purchase price paid for the product.


8. DISCLAIMER OF ADDITIONAL WARRANTIES

Except as expressly stated in this policy, all products and equipment are sold “AS IS” and “AS AVAILABLE.”

Zeyond Clinical expressly disclaims, to the fullest extent permitted by law, all additional express or implied warranties, including but not limited to:

  • Implied warranties of merchantability
  • Fitness for a particular purpose
  • Unwritten warranties
  • Oral warranties
  • Warranties arising from commercial usage

No employee, representative, or third party is authorized to modify this policy.


9. GOVERNING LAW AND JURISDICTION

This policy shall be governed and interpreted in accordance with the laws of the Commonwealth of Puerto Rico and applicable federal laws of the United States.

Any controversy, claim, or dispute arising from purchases made through Zeyond Clinical shall be subject exclusively to the jurisdiction of the competent courts of Puerto Rico.

Customers expressly waive the right to participate in class actions, collective claims, or mass arbitration proceedings against Zeyond Clinical.


10. MANDATORY ACCEPTANCE

By completing a purchase, using our products, or accessing our services, the customer confirms that they:

  • Have read this policy in its entirety
  • Fully understand its terms
  • Voluntarily accept all conditions stated herein
  • Waive, to the extent permitted by law, any claims inconsistent with this policy
